Is Permanent Residence Still Conditional for Sponsored Spouses? (2026)

The short answer: No. According to IRCC, conditional permanent residence for sponsored spouses and partners was eliminated on April 28, 2017. A sponsored spouse or partner no longer has to live with the sponsor for two years to keep permanent residence. If a Confirmation of Permanent Residence was issued on or after April 18, 2017 and mentions the two-year requirement, IRCC says that requirement no longer applies. Other rules still apply: the 3-year undertaking, the five-year sponsorship bar and the ban on marriage fraud.

What was conditional permanent residence?

For a time, some sponsored spouses and partners had to live with their sponsor for two years to keep permanent residence. It applied if the relationship was less than two years old at the time of the application and the couple had no children together.

What changed on April 28, 2017?

IRCC's notice says conditional permanent residence no longer applies to anyone, so no action is needed. People who were under investigation for not meeting the two-year requirement are no longer under investigation. If you see old websites, forums or videos describing the two-year rule, they may be out of date.

What rules still apply?

Removing conditional permanent residence did not remove every rule for sponsored couples:

  • The undertaking. The sponsor promises to support basic needs for 3 years after the partner becomes a permanent resident, even if the relationship ends. See what the undertaking means after separation.

  • Marriage fraud. IRCC still investigates marriages entered mainly for immigration purposes. Misrepresentation can lead to loss of status and a ban. See what officers look at.

  • The five-year bar. A person who was sponsored as a spouse or partner cannot sponsor a new spouse or partner until five years have passed since they became a permanent resident (time as a citizen can also count under the regulations). The rule applies to applications received on or after March 2, 2012. See who can sponsor.

What if my sponsor is abusive?

IRCC's notice says sponsored spouses or partners facing abuse or neglect from the sponsor or the sponsor's family do not have to stay in that situation, and it points to resources for help. If you are in danger, contact local emergency services. IRCC also publishes immigration options for victims of family violence.

Who does this affect?

  • Sponsored spouses who are worried about staying with their sponsor

  • Sponsors who have heard of a two-year rule

  • Couples reading older immigration material

What should you do?

  1. Check the date on any document or website that mentions conditional permanent residence.

  2. Read the IRCC notice.

  3. If your Confirmation of Permanent Residence mentions two years, note the IRCC statement that the requirement no longer applies.

  4. Learn what the undertaking and the five-year bar mean.

  5. If you are unsure, get advice on your own file.
