H&C for International Students: Can a Study Permit Holder Apply?

The short answer: IRCC describes humanitarian and compassionate (H&C) consideration as an exceptional measure, not a regular route to permanent residence. A person on or after a study permit may be able to ask for it, but wanting to stay after studies is not by itself a humanitarian ground. IRCC's Guide 5291 says the applicant must be in Canada and cannot be eligible under the spouse or common-law, economic, protected person or temporary resident permit holder classes. Most students should first check whether another route fits. No result is guaranteed, and the decision is made by IRCC.

What does "exceptional measure" mean for students?

IRCC's H&C page says H&C is an exceptional measure that allows an officer to exempt a person from usual requirements or grant permanent residence when there are sufficient and compelling grounds. Section 25 of the Immigration and Refugee Protection Act (IRPA) is the legal basis. The guide also says that the cost and inconvenience of applying from abroad are not enough alone.

For a student, that means the normal wish to remain and work after graduation is unlikely to be treated as exceptional on its own. The factors IRCC names include establishment in Canada, ties to Canada, the best interests of children, health, family violence, separation from relatives and country conditions. Whether any of them apply to you depends on your facts.

Does being on a study permit help or hurt?

We could not find IRCC guidance that addresses study permit holders as a group, so we will not claim a rule either way. Some things IRCC's establishment guidance does say are worth keeping in mind:

  • Officers consider whether the circumstances that led the applicant to remain in Canada were beyond their control. Whether that applies after a study permit ends depends entirely on the facts.

  • Education, including professional or linguistic studies, is listed as a sign of integration.

  • IRCC says some degree of establishment is not necessarily sufficient for relief.

What if my study permit has expired?

If you stayed after your permit ended, other issues arise, such as restoring status or applying from out of status. Our guides on H&C after a permit expires and H&C out of status cover those. IRCC's guide also says applying for H&C does not stop removal, so anyone facing a removal date should speak to a lawyer or other qualified representative right away.

How does H&C compare with other routes?

Because H&C is exceptional, most former students look at other options first:

  • Express Entry. IRCC uses it for the Canadian Experience Class, Federal Skilled Worker and Federal Skilled Trades programs. IRCC announced changes to how points and job offers are assessed that take effect November 3, 2026, so check its current rules. For the Canadian Experience Class, IRCC's rules say work must be authorized, and work done while studying full-time is not counted.

  • Provincial nominee programs. Some provinces nominate people with work or study ties. Details vary by province, so check the province's own rules.

  • Family sponsorship. If you have a Canadian spouse or common-law partner, a spousal route may apply. See H&C vs spousal sponsorship.

  • Protection. If you fear return, a refugee claim is separate from H&C. See H&C vs refugee claim.

Our overview of H&C vs other PR pathways compares these side by side. IRCC's Guide 5291 says an H&C applicant must not be eligible under the economic classes, so an honest look at those routes is part of the analysis.

What I should not assume

  • Work or study while an H&C application is pending. We have not verified that an H&C applicant is allowed to work or study during processing, and IRCC's bridging work permit page does not list H&C. Check IRCC's current rules for your exact situation before relying on any permission.

  • Travel. Do not assume you can leave and return while an application is pending without taking advice.

  • Timelines. Use IRCC's processing times tool and read our guide to H&C processing time.

Frequently asked questions

Can I apply for H&C while I still hold a valid study permit?

IRCC's guide requires the applicant to be in Canada. It does not, in the pages we reviewed, make expired status a requirement. Whether it is wise depends on whether you could instead use another route.

Do good grades or a job offer make a strong H&C case?

They may be relevant to establishment, but IRCC says some degree of establishment is not necessarily sufficient.

Next steps

Write down why leaving Canada would cause serious difficulty beyond the ordinary disappointment of ending your studies, and check whether a different route fits first. Every H&C situation is different. E-Pathway Immigration can help you assess whether H&C considerations may be relevant, identify the evidence and questions that need attention, and understand your options. A decision remains with IRCC.
