Can You Apply for H&C From Outside Canada? What IRCC Says (2026)

The short answer: According to IRCC, its inland H&C application is for people in Canada who need an exemption from IRPA or its Regulations. From abroad, IRCC's operational guidance describes H&C requests made inside a permanent resident visa application under the economic, family or refugee classes. Check IRCC's pages against your own facts.
What is the current IRCC position on H&C and location?
As of October 16, 2026 (the date shown on the page), IRCC's H&C application page says to use that application if you are in Canada and need an exemption from one or more requirements of the Immigration and Refugee Protection Act (IRPA) or its Regulations to apply for permanent residence from within Canada. IRCC also says H&C consideration is "an exceptional measure."
As of June 11, 2026 (the date shown on the page), IRCC's operational guidance for officers has a separate page on H&C in permanent resident visa applications from outside Canada. It says it covers applicants under the economic, family or refugee classes.
For the basics of the inland program, see who can apply for H&C.
What does the law say about in Canada and outside Canada?
Section 25(1) of the IRPA is the source of H&C discretion. Reading the section on the Justice Laws website, it has separate wording for each setting:
In Canada: the Minister must, subject to subsection 25(1.2), examine a request from a foreign national in Canada who applies for permanent resident status and who is inadmissible or does not meet the requirements of the Act.
Outside Canada: the Minister may, on request, examine the circumstances of a foreign national outside Canada who applies for a permanent resident visa.
Both limbs carry a carve-out for inadmissibility under section 34, 35, 35.1 or 37, but it is worded differently in each. Read the section itself before relying on a summary.
Can you apply for H&C as a visitor abroad?
Neither IRCC page we read describes a separate route for visitors abroad. IRCC's operational page covers H&C requests inside economic, family and refugee class applications. If you stayed past your status and then left, see H&C and visitor overstay for the status side of the question.
How is an outside-Canada H&C request different from an inland one?
Here is the difference, based on the IRCC pages we read:
How it starts (inland): IRCC's deputy minister transition binder (modified September 4, 2026) says that in Canada, applicants "can apply for H&C directly."
How it starts (overseas): the same binder says overseas, applicants "can request H&C as part of an existing permanent residence application."
Who carries the burden: the overseas guidance (last modified June 11, 2026) says "The applicant bears the onus of satisfying the decision-maker" that the H&C factors justify an exemption.
Procedural fairness: the overseas guidance says "A procedural fairness letter is required for any extrinsic information." See procedural fairness letters.
IRCC's August 27, 2026 program delivery update says six H&C instructions received "minor updates." It does not describe the changes, so check the current instruction.
Does a positive H&C decision end the process?
No. IRCC's overseas guidance says a positive H&C decision does not end the process. The applicant must still meet the remaining visa requirements: medical exam, criminal record check and security screening. Once all requirements are met, a permanent resident visa may be issued. For inadmissibility, check IRCC's page on inadmissibility.
What about fees and biometrics?
We are not giving fee amounts, because we could not read a current IRCC figure for an outside-Canada H&C request.
Inland application: IRCC's H&C page says that in most cases your fees will include processing fees, the Right of Permanent Residence Fee, biometrics and third-party fees. For more, see H&C costs and fees.
Outside Canada: the operational page does not address forms, fees, biometrics or where to apply. Check the guide for the class you are applying under, and IRCC's fee tool.
Where do you apply from outside Canada?
The operational page does not say where or how to apply. Check the guide for the class you are applying under. IRCC's H&C page also says that the cost and inconvenience of returning to your home country to apply are not sufficient reasons for H&C consideration. See is H&C a last resort and other PR pathways.
What should you do?
Confirm where you are now and what status you held when you left.
Identify the permanent residence class you could apply under, if any.
Read IRCC's inland H&C page and the outside-Canada operational page for your situation.
Collect evidence of establishment, family ties, a child's interests and hardship. See the H&C documents checklist.

Frequently asked questions
Can I apply for H&C from outside Canada?
IRCC's inland H&C application is for people in Canada. IRCC's operational guidance describes H&C requests from outside Canada inside permanent resident visa applications under the economic, family or refugee classes.
Is there a separate H&C form for people abroad?
We did not find one described in the IRCC pages we read. The outside-Canada guidance does not address forms, so check the guide for your class.
Does section 25(1) of the IRPA apply outside Canada?
Yes. It has separate wording for a foreign national outside Canada who applies for a permanent resident visa. That limb excludes foreign nationals inadmissible under section 34, 35, 35.1 or 37.
Can I apply for H&C after I leave Canada?
IRCC's inland page describes the application for people in Canada. After leaving, a request would be framed differently. Get advice on your facts and dates.
Is the process faster from abroad?
We cannot say. We did not read any IRCC figure comparing the two, so check IRCC's processing times tool for the application you are filing.
Do I still need a medical exam and police checks?
IRCC's overseas guidance says a positive H&C decision does not end the process. The applicant must still meet the remaining visa requirements, including a medical exam, criminal record check and security screening.
Does the cost of travelling home count as a reason?
IRCC says the cost and inconvenience of returning to your home country to apply are not, by themselves, sufficient reasons for H&C consideration.
